On June 19, 2023, the Financial Supervisory Service of the Republic of Korea issued communications about the Foreign Exchange Transactions Act regarding regulatory requirements for Korean residents. These requirements state that Korean residents may violate the Financial Investment Services and Capital Markets Act by selling non-Korean-listed stocks acquired through a non-Korean brokerage institution, including stocks acquired through their employer`s equity compensation program.
// 2023년 6월 19일, 대한민국 금융감독원은 한국 거주자에 대한 외환거래법에 관한 통보를 발행했습니다. 이 통보에 따르면 한국 거주자는 한국 증권거래법을 위반할 수 있습니다. 이는 한국 거주자가 비한국 중개기관을 통해 취득한 비한국 상장 주식, 즉 고용주의 자본 보상 프로그램을 통해 취득한 주식을 말합니다.

Additionally, administrative fines may also be imposed for violating the Foreign Exchange Transaction Act by depositing sales proceeds of non-Korean-listed stocks in a non-Korean financial institution. Further details about this regulatory requirement can be found here.

When a Korean resident is ready to sell shares:// 한국 거주자가 주식을 판매할 때:

If this regulation applies to you, you should utilize an existing account with a Korean domestic broker (or open a new account with a Korean domestic broker if you do not already have one) and sell foreign-listed shares through the Korean domestic broker. If you decide to sell current shares held in your E*TRADE account, you will first need to transfer shares from E*TRADE by completing and submitting our Stock Plan Transfer Request Form.

Important: Whole share transfer amounts (e.g., 100 vs. 100.23) should be entered in the online form, since including partial shares would initiate a sale in the E*TRADE account.

Transfer requests may take a minimum of 10-15 business days (or longer) from the initiation date. Processing times can also vary and may be shorter if your Korean broker partners with a United States securities clearing firm.
